Lawsuit Claims Bank of America Switched Credit Card Welcome Bonus
In January 2025, Jean-Baptiste Boyer-Gomez filed a class-action lawsuit against Bank of America in the U.S. District Court for the District of Massachusetts.
The lawsuit alleges that Bank of America engaged in deceptive practices by altering the terms of a credit card agreement after Boyer-Gomez had already begun fulfilling his obligations under the original welcome offer.
Specifically, Boyer-Gomez claims that he applied for an Air France KLM World Elite Mastercard 70,000 bonus miles plus 40 XP (experience points) after making $3,000 or more in purchases within the first 90 days of opening their account. However, after he started using the card, Bank of America allegedly replaced this offer with a different one, thereby failing to honor the initial terms. The new offer was inferior, with only 50,000 bonus miles and 60 XP after making $2,000 or more in purchases within the first 90 days.
The lawsuit claims violations of the Massachusetts Consumer Protection Act, breach of contract, breach of the implied covenant of good faith and fair dealing, and unjust enrichment. Boyer-Gomez seeks declaratory and injunctive relief, as well as actual and treble damages for himself and all class members.
